What Happened
The Federal Trade Commission and state partners allege that Hims & Hers told consumers they could connect with a medical provider to find a treatment that was right for them, while charging some consumers and enrolling them in recurring prescription plans after they submitted an intake form.
The complaint says most consumers did not receive a consultation before the charge and subscription. The agency also alleges that refills and billing dates were not clearly disclosed, creating the classic subscription experience: easy to click, strangely difficult to escape.
Cancel Culture, Literally
The FTC says Hims made cancellation hard even after adding online cancellation. According to the complaint, the button was hidden behind an “add/remove items from order” path and several screens before the word “cancel” appeared. That is not a cancellation flow. That is an escape room with a recurring charge.
The company is accused of sharing health information with Meta, Snap and other advertising platforms, including through customer lists and tracking technologies that reported certain website actions. The FTC says this happened despite statements that consumers' health information would be kept private.
Important Footnote
These are allegations in a federal complaint. The case will be decided by the court. Hims provides telehealth services and direct-to-consumer prescription medications, and the complaint does not mean every customer had the same experience. It does mean that “privacy” and “you won't be charged yet” are not decorative phrases if the business model operates differently underneath.
The Dumb Part
Healthcare is already a trust exercise conducted while everyone is tired and staring at a phone. The alleged workflow adds a billing subscription before the promised conversation, then hides the exit and sends sensitive health signals toward advertising companies. At that point the patient is not navigating telehealth; the patient is navigating a funnel wearing a lab coat.
